Terms of Service

☆ By requesting a commission, you agree to the following terms:☆ Do not post any of my commissions without directly linking to my socials. Please credit me as @myokogu unless you prefer to use the hashtag #myokogu (on places like twitter) which is also fine! I just ask that credit be visible somewhere.☆ I am willing to draw: OCs, Fan-Art, Custom Designs, Kemonomimi, Ship Art, Suggestive designs / some nudity is OK, Anthro is OK (flat-face furries are OK).☆ I am NOT willing to draw: Hentai (ecchi is OK), ask for examples if need be), Realistic animals, Mecha, Elderly, Some Gore is OK.

Payments & Refunds

☆ Refunds can only be requested if I have not begun working on the art.☆ Commissions are not “First Come First Served” (FCFS).☆ All commissions must be paid upfront in full OR 50% upfront and the remaining 50% once the sketch is completed. Payment plans are OK but be aware that I will not work on the comm further than the sketch if the remaining amount has not been paid.☆ Please do not discuss any personal details revealed during the transaction.☆ All payments will be handled through PayPal, VGen, or Ko-Fi!

Usage

☆ Copyright: I retain full copyright of all my artworks, including commissioned pieces. I am allowed to use them for portfolio purposes UNLESS the client wishes for me not to.☆ Commercial Usage in my definition: merchandise to be sold (art that will be made into physical and digital merch like keychains, prints, etc.)☆ Personal Usage in my definition: Profile pictures, banners, etc., personal prints or merchandise (that you do not intend to sell / monetize in any way), and art that you just want to keep on Toyhouse, in a folder, etc.☆ Commercial licenses will always be 100% of the price (unless already included in the price).

Workflow & Delivery

☆ Delivery time can vary between 1 week to 1 month. If I need more time, I will discuss that with you in DMs.☆ Hard deadlines shorter than 1 week from the request date may incur a $5 rush fee.☆ Files may be removed from my computer at any point, so please ensure everything is up to standard.

Communication

☆ All communication will be held on VGen or Twitter. Discord is OK but DMs can be lost easily </3.☆ I will reach out to you to update you on the progress as it is made. Please feel free to contact me at any time for additional updates! Updates will mostly be visual.

Adoptable Terms

☆ By purchasing or bidding on an adoptable from me, you agree to the following terms:

General

Please be mindful that rules are subject to change in the future as I experiment with what works best.☆ Adopts are not necessarily First Come First Serve – first to be able to pay has priority (upfront payment > holds or payment plans; but both of these things are perfectly fine and accepted so long as they are within reason).☆ Disclose if you need a payment plan or hold during auctions by using "PP" next to your bid! Holds & PP can extend up to ~1 month.☆ DO NOT BID ABOVE YOUR MEANS Backing out before the auction has been closed / transferred to new owner will result in a blacklist.☆ Do not sell/trade my designs to my list of blocked/blacklisted users (list pending)☆ You may not create lookalikes relating to my designs. This includes theming, color picking, copying too many aspects at once.☆ All adoptable designs & prices are final. This means I will not edit the adopt after purchase, but feel free to do so yourself so long as there is an original, unedited file saved somewhere. All layers are merged together at time of sale.☆ Please do not guilt-trip, harass, or beg for the design.☆ This only applies to Toyhouse users: If you have a privated design of mine, please make sure I'm authorized and able to access it since I do like to keep track of my adopts. If my design is not on Toyhouse, please notify me first before it is traded / sold. I would prefer if you had a Toyhouse so that I can transfer it to you, but it is not necessary.☆ I have the right to post the work on any of my platforms or to self-promote the piece.

Payment Information

☆ If you already have pending money owed, you must pay the owed amount before making any new purchase. You may also pay for both in full at payment date or add on the new amount to the already owed amount on a PP.☆ If you break my TOS in any way, your ownership of the design will be revoked and will go back to me. I am allowed to use it for any other purposes, including resale. If caught using the design unauthorized, I will take action. Breaking my TOS over 3 times can also put you on a blacklist (3rd strike = blacklist). Some offenses will put you there immediately (such as chargeback, ghosting, refusal of payment, etc.)☆ If there is no payment within 24hrs without a valid reason, the adoptable will be automatically considered as “canceled” & will go to the 2nd in line.☆ Commercial usage is always included in the highest AB/SP. During auctions, it will be included once a certain amount has been reached. Commercial fee may be purchased at a later date.☆ No refund (including down payment) will be given, no matter the reason. Payment is via PayPal or Ko-Fi. I will send you all the files after I have received the entirety of the money. You will have full ownership after the full payment. Do not claim for it to be yours if you haven’t paid in its entirety.

Usage Guidelines

☆ Please credit me for the design. Redesign/reselling/trade/gifting is okay but not at a higher price than bought, unless extra art or add-ons has been bought. However, the price should be reasonable. Instant reselling is also prohibited.☆ If redesigning or editing, it should look somewhat similar to the original adoptable; please keep a copy of the original version somewhere.☆ Clients cannot claim to have made the art, design, use it for AI, use it for NFT or similar, use it for commercial without paying the commercial fee, etc.☆ My designs / adoptables must NOT be used to spread any hateful rhetoric of any kind. This includes but is not limited to: racism, homophobia, transphobia, neo-n*zi, loli/shotacon, etc.
